Trial date postponed in fatal crash

The driver in a fatal car crash that took place on Fitzwilliam Road in Jaffrey on Jan. 5 is set to plead guilty on Jan. 28, 2014, according to Cheshire County Superior Court documents available Monday.

Nichole Oates, 35, of Rindge is accused of driving while intoxicated and causing serious bodily injury and the death of her 34-year-old boyfriend, Daniel Peard of Jaffrey.

Oates was indicted in February on two counts of negligent homicide, two counts of aggravated DWI, and one count of reckless conduct with a deadly weapon. Oates was indicted on one more count of negligent homicide in July.

Oates was released on $5,000 bail, following arraignment in January. On Oct. 25, Oates filed a notice of her intent to plead guilty to charges of negligent homicide. On the same day, Oates filed a request to set plea and sentencing for a date in January, which would give her enough time to arrange for the care of her three young children. Judge John C. Kissinger, Jr. granted this request on Nov. 5.
