Two see rioting charges

KEENE — A Cheshire County Grand Jury indicted two men — one from Peterborough and the other from Keene — last week for alleged rioting, in connection with a physical altercation in downtown Jaffrey this past winter that left one person injured. A Hancock man allegedly firing a gun was charged in the incident, too.

Michael Donnelley, 28, of Peterborough and Jackson Piscapo, 20, of Keene were both indicted on June 24 for allegedly assembling with a handful of others on Feb. 8 on Main Street for the purpose of engaging in violent conduct, according to Superior Court documents available Monday. Both are facing felony-level charges.

A Hancock man also faces a felony-level charge in connection with the incident, after police say he fired a handful of shots from a 380-caliber handgun during the altercation. Evin Tracy, 18, of Hancock was arrested on a warrant issued by the Jaffrey Police Department on Feb. 19, charging him with reckless conduct. The case has since been forwarded to the Cheshire County Superior Court, but no indictment has been handed down as yet.

According to an affidavit for Tracy’s arrest prepared by Lt. Terry L. Choate, Tracy allegedly pointed a handgun at the head of a Jaffrey man, then “lowered the gun slightly and fired two rounds in [the victim’s] direction and the direction of the ground.” Tracy also allegedly hit the victim over the left eye with the body of the firearm, causing injury that required treatment at Dartmouth-Hitchock Medical Center.

Donnelley and Piscapo were with Tracy when he fired the shots, according to police.

In an unrelated case, Albert Magnifico, 27, of Jaffrey was indicted on one count of driving after having been deemed a habitual offender. Magnifico allegedly drove his Ford pickup on Mountain Road in Jaffrey on March 22, after his driving privileges in New Hampshire had been revoked in June 2009, according to court documents.
