Arrest in July 2011 rape

A Jaffrey man has been charged with aggravated felonious sexual assault, in connection with an incident that took place at Riverview Apartments in Peterborough in 2011.

Benjamin Sprague, 26, was arrested Wednesday in Jaffrey.

According an arrest affidavit filed last week by Peterborough police, a woman went to Monadnock Community Hospital on July 3, 2011, and reported a sexual assault. The hospital took samples for a sexual assault rape kit.

The woman told police she had been at a friend’s residence at Riverview Apartments the night before, along with Sprague and three other people. She said she had too much to drink and fell asleep, and when she awoke, she found Sprague touching her leg and trying to put his hand up her shorts. She said she objected and pushed him off twice. She later noticed a wetness in her shorts that she said smelled like semen and said she didn’t remember having sex during the night.

Police interviewed Sprague on the evening of July 3, 2011, and he said he had fallen asleep early and did not molest the woman.

After the state forensic laboratory analyzed the rape kit evidence, police got a warrant to obtain DNA samples from Sprague, but were unable to locate him until December 2013. At that time, according to the affidavit, Sprague told police he had sex with the woman three to five days before she reported being assaulted.

The woman told police she had not had sex with Sprague shortly before the alleged assault, saying she had sex with him once, a one-night stand several years ago.

After Sprague’s sample tested positive as a match with the DNA/semen from the rape kit, police obtained an arrest warrant on Jan. 9

Sprague was arraigned in 8th Circuit Court in Keene after his arrest. Bail was set at $50,000 cash and Sprague is being held in Valley Street Jail in Manchester. A probable cause hearing is scheduled for Jan. 28 in 8th Circuit Court, Jaffrey.
