A Mason man has been indicted on charges alleging that he had sex with a minor without her consent. 

John Mccann, 19, was recently indicted on one count of felonious sexual assault and one count of aggravated felonious sexual assault at the Hillsborough Superior Court in Nashua. 

Court records allege that the incident in question took place on May 7, 2017 in Merrimack. 

Mccann allegedly had sex with the minor – who was 14 at the time – despite her indicating “by speech or conduct that there was not freely given consent,” according to the indictment. 

Felonious sexual assault is a class B felony, carrying a sentence of up to 3 ½ to seven years in prison and up to a $4,000 fine.

Aggravated felonious sexual assault is a class A felony, carrying a sentence of up to 10 to 20 years in prison and up to a $4,000 fine.

Emily Atwood, 38, of Wilton, was indicted on charges of theft by deception and theft by unauthorized taking.

On May 27, Atwood allegedly took items from Ocean State Job Lot in Nashua and attempted to return them to the store for store credit. Atwood allegedly was going to use said store credit to make purchases at the store.

Atwood was previously convicted of two counts of receiving stolen property in 2016. 

Each charge is a class B felony with a potential sentence of up to 3 ½ to seven years and up to a $4,000 fine.
