Lyndeborough proposes wetlands buffer ordinance

Lyndeborough’s proposed zoning amendments this year include better protections for the town’s wetlands.

There are two proposed zoning amendments coming before voters at the March polls, though only one makes substantive changes to the code. The Planning Board held a public hearing on both articles Thursday evening.

The first proposed article would include a 50-foot buffer requirement in the wetland district. The wetlands district encompasses all areas in town that have “poorly” or “very poorly” drained soils, and is an overlay district, with rules of both the underlying district and the wetlands district applying.

The current ordinance outlines the permitted uses – among them forestry, agriculture, water impounds and wells, drainage, wildlife refuges, parks and recreation, conservation areas and open space – as well uses allowed with a special exception issued by the Zoning Board.

It does not, however, include any reference to a buffer around the wetlands, which the proposed ordinance would address.

According to the Environmental Protection Agency, wetlands are an important part of a town’s water resources, as they often act as a filter for water in the town’s aquifers or groundwater. Putting a buffer between the wetlands and permanent structures or their construction helps to keep the wetlands from contaminants and preserve water quality.

The second proposed amendment includes various updates and clarifications, but no major changes that affect the code, including updating definitions, clarifying setback requirements for septic systems and wells and frontage requirements for large tract land developments, among other changes.

Both articles must be voted on by the public in the polls in March, and require a majority vote to pass.
