Amended PURD development to return before ZBA

A 59-unit housing development in Rindge will likely be revisiting the Zoning Board with updated plans, rather than pursuing a State Housing Board appeal.

Navian Development of Rindge filed an appeal of a Zoning Board decision last week, appealing the rejection of a 59-unit Planned Unit Residential Development on Route 119. The Zoning Board denied a special exception needed for the project, based on plans to have water drainage too close to a wetlands buffer. Navian appealed that decision to the Zoning Board directly, but the Zoning Board upheld its original decision.

On Aug. 20, Navian filed an appeal of the decision to the State Housing Appeals Board, a process established last year by the state legislature that reviews Planning and Zoning Board appeals.

However, Navian Development, through its attorney, John Ratigan, of the Exeter law firm Donahue, Tucker & Ciandella, offered to put a stay on the appeal if the town was amenable to the firm re-appearing before the Zoning Board of Adjustment with an updated plan.

The main objection to the plan offered by the Zoning Board as the basis for their rejection was the issue of drainage within the wetlands buffer. In an interview Friday, Ratigan said developers have revised their application to move the drainage swale out of the wetlands buffer and across the street.

During its meeting on Wednesday, the Rindge Select Board discussed the matter in non-public, but during the public portion of the meeting, disclosed they were amenable to that solution, and had directed Town Administrator Sara Gravell to respond through the town’s attorney that they accepted the offer to stay the case.

Ratigan said avoiding further appeals is the best outcome for all involved, and if the revised plan is accepted by the Zoning Board, they will fully dismiss the request to appeal to the state board. Ratigan said if the town moves forward with its intent to accept the offer to re-review the amended plan locally, he will file a stay with the state board, and the amended plans will likely be back before the Zoning Board as soon as the end of this month.
