Jury hands down sex, drug charges

An Antrim man and a Bennington man were both indicted on May 15 in Hillsborough County Superior Court in Manchester, one on sexual assault charges and the other for sale of drugs.

A Grand Jury indicted Shawn Mooney, 26, of Bennington, on two counts of aggravated felonious sexual assault and one count of felonious sexual assault, for allegedly touching a female juvenile. The alleged assaults took place on or between Jan. 1, 2010, and Jan. 10, 2014, in Bennington. The girl who was allegedly assaulted was born in December 2004.

The aggravated felonious sexual assault indictments state that Mooney “engaged in a pattern of sexual assault against another person.” They state that Mooney committed more than one sexual act upon the same girl over a period of two months or more and within a period of five years, by touching her buttocks in the victim’s living room and in the victim’s mother’s bedroom.

Each aggravated felonious sexual assault charge carries a potential sentence of 10 to 20 years jail time and a $4,000 fine.

The indictment for felonious sexual assault, a Class B felony, states that on Jan. 18, 2014, Mooney allegedly touched the same young girl on her buttocks in the juvenile’s bedroom, in Bennington. On that charge, Mooney faces a potential three and a half to seven years prison sentence and a $4,000 fine.

Brian Mitchell, 21, of Antrim was indicted on a charge for the sale of a controlled drug. According to the indictment, in late January Mitchell, “knowingly sold less than one ounce of the controlled drug marijuana to [an] agent of the Antrim Police Department in exchange for a sum of money.”

Mitchell was previously convicted of violating state laws relating to controlled drugs, the indictment states. Sale of a controlled drug is a special felony that could result in three to six years at the House of Correction and a $50,000 fine.
