Atlas owner pleads guilty to illegal dumping

The company that leases land to Atlas Fireworks in Jaffrey has pleaded guilty to illegally disposing of old televisions and video monitors.

Atlas owner Stephen Pelkey, representing PLH, LLC, the land-leasing company that he also owns, agreed to the terms of a plea deal on Tuesday. PLH will be sentenced on Sept. 16 at the Cheshire County Superior Court.

“PLH management is pleased that an agreement has been reached with the State of NH that will bring the legal process to a conclusion,” said Pelkey, in a statement Wednesday. “The company has accepted the State’s penalty and today is much better educated regarding waste management practices and requirements for the handling of CRT.”

PLH, LLC is scheduled to pay a $250,000 fine plus a $10,000 penalty assessment over the next three years, after being charged with two counts of unlawful operation of a solid waste facility, according to prosecuting attorney Lauren Noether. An additional $250,000 fine will be suspended for 10 years pending good behavior.

Noether said, two charges of unlawful operation of a solid waste facility against Atlas PyroVision Entertainment Group, Inc. will be dropped.

Atlas and PLH had operated a private solid waste facility at 136 Old Sharon Road, where Atlas is headquartered, between approximately July 4, 2010, and Aug. 20, 2013.

Indictments said that Atlas and PLH knowingly kept buried solid waste – namely cathode ray tubes – and waste monitors with cathode ray tubes on the property without a DES permit.

Defense attorney Michael Ramsdell said that all of the monitors and other waste have been cleaned off the property with the exception of some of the stored items, which should be shipped out by the second week of August. Ramsdell said much of the clean-up was completed three years ago.
